In the last years of his life, Gerald C. MacCallum, Jr., defied illness to continue his work on the philosophy of law. This book is a monument to MacCallum’s effort, containing fourteen of his essays, five of them published here for the first time. Two of those previously published are widely admired and reprinted: “Legislative Intent,” certainly one of the best papers ever published on its topic, and “Negative and Positive Freedom,” which offered a new way of looking at (...) a distinction that had been canonical for the last two centuries. To complete MacCallum’s unfinished pieces, Marcus G. Singer and Rex Martin painstakingly consulted MacCallum’s notes for planned revisions. MacCallum discusses legal reasoning, the application of rules, the interpretation of statutes and constitutional provisions, and the relation of these matters to morality and justice. In the last decade of his working life, he became greatly concerned with the interrelated themes of integrity, autonomy, conscience, and violence. He wished to relate competition to morality and justice to adversarial systems of law. These themes are woven together in Legislative Intent and constitute the main subject of some of the essays. MacCallum was engaged in a constant search for truth and understanding, and in his life and work lived up to Emerson’s vision of the “American Scholar” as a “human being thinking.” These essays are informed by the author’s deep curiosity, penetrating intelligence, wide knowledge, and outstanding character. They will be treasured wherever these characteristics and true philosophy are treasured. (shrink)

What if sounds everywhere lavish divine generosity? Merging insights from Jean-Luc Marion with musical ingenuity from Pierre Boulez and John Cage's 4'33", Gerald C. Liu blends the phenomenological, theological, and musical to formulate a hypothesis that in all places, soundscapes instantiate divine giving without boundary. He aims to widen apprehension of holiness in the world, and privileges the ubiquity of sound as a limitless and easily accessible portal for discovering the inexhaustible magnitude of divine giving.

This experiment examined responses to excerpted episodes from short stories that either focused on action or on the experiences of the characters. The effects of instructional sets to approach the texts from the viewpoint of subjective involvement or objective detachment were also studied. The two story types and two reading sets were factorially combined in a within-subjects design. Scale ratings of the story excerpts and reading times (syllables per second) were measured. A total of subjects (20 males and 20 females) (...) read six segments from each of the episodes as quickly and accurately as possible. Pretest data were obtained for each segment indicating how much it “provided insight into the characters' experiences”, and its level of suspense and surprise. Segments which “provided in sight” were read more slowly, whereas surprising segments were read more quickly. Under the Subjective Set, subjects slowed the pace of reading if they judged the text to be “rich in meaning about life”. For the Objective Set, stories that were judged to have evoked “images” were read more slowly. Females were more responsive to the Subjective Set than were the males, finding the stories to be “richer in meaning” and more “personally relevant”. Females also slowed their reading pace for segments that they judged to be “rich in meaning about life”, while males slowed down if the stories evoked “images”. (shrink)

Argues that relations between mind and body are analogous to those between subject matter and style in art.

This study examined the effects of emotional subject matter and descriptive style in short story excerpts on text (e.g. rich in meaning) and reader response-oriented (e.g. liking) ratings. Forty-eight subjects, including equal numbers of trained and novice male and female students, read two examples of each text twice and either generated or received interpretations between readings in a within-subjects design. In general, intellectual challenge slowed the pace of reading, whereas suspense-based arousal increased it. Emotional subject matter had a more powerful (...) effect than descriptive style on both cognitive (challenging, rich in meaning) and affective (expressive, personally relevant) scales and were read more quickly. Generating interpretations fostered subjective reactions to the Emotional excerpts (images), whereas Descriptive texts were less amenable to subjective responses. Consistent effects were also found for background and gender. As in everyday life, subject matter had a dominant effect in engaging a person's involvement. (shrink)

The Distancing-Embracing model proposes that negative emotions embedded in literary works can be rewarding. This is consistent with a holistic ontology in the German Romantic tradition. However, the application of cognitive psychology to explain experiences of aesthetic pleasure is problematic because it is founded on a mechanistic Enlightenment epistemology. The appreciation of negative emotions requires cognitive elaboration and closure, whereas hedonistic reward is contingent on the reader's needs, in the moment, for pleasure or distraction.

The popular slogan that one ought to fight for what he believes right appears to point a way for persons to witness the moral seriousness of their interest in reform. But exactly what way does it point, and, in particular, does it enjoin resort to violence for the sake of what one believes right ? Pursuit of this question exposes some roots of our indecisive and often confused views about the acceptable means of revolution and reform and the eventual r61e (...) of violence therein. Common understandings of ?violence? and ?fight for? do not carry us far. Further, there are doubtless differences in how the slogan's enjoinment of ?fighting? (and thus, if at all, of violence) is understood to be limited. These differences and the issues underlying them are exposed when we ask whether the slogan is to be understood to enjoin fighting or manners of fighting that might be called premature, gratuitous, or wasteful, and when we ask whether the ?ought? in the slogan is to be understood as, at best, a prima facie ought. Recent advances in machine learning methods have created opportunities to eliminate unfairness from algorithmic decision making. Multiple computational techniques (i.e., algorithmic fairness criteria) have arisen out of this work. Yet, urgent questions remain about the perceived fairness of these criteria and in which situations organizations should use them. In this paper, we seek to gain insight into these questions by exploring fairness perceptions of five algorithmic criteria. We focus on two key dimensions of fairness evaluations: distributive fairness and procedural fairness. (...) We shed light on variation in the potential for different algorithmic criteria to facilitate distributive fairness. Subsequently, we discuss procedural fairness and provide a framework for understanding how algorithmic criteria relate to essential aspects of this construct, which helps to identify when a specific criterion is suitable. From a practical standpoint, we encourage organizations to recognize that managing fairness in machine learning systems is complex, and that adopting a blind or one-size-fits-all mentality toward algorithmic criteria will surely damage people’s attitudes and trust in automated technology. Instead, firms should carefully consider the subtle yet significant differences between these technical solutions. (shrink)

The Harold Pinter Archive at the British Library contains correspondence dating from 1977 to 2008, including his e-mail archive. In total, the correspondence strand of the archive contains c.20,000 paper letters and c.3500 e-mails. This project used data analytics (in Python) and network visualisation (in Gephi) to interrogate the ways in which digital and analogue correspondence function together within Pinter’s literary archive. The attendant paper reflects upon what this analysis might mean for archivists, curators and researchers working with hybrid correspondence (...) collections in the context of Digital Humanities and Artificial Intelligence based research methodologies. The paper includes an analysis of what an email is both materially and functionally—what are its constituent parts and in what ways is it like and unlike a physical letter, as well as a discussion of how we can leverage the highly structured nature of e-mail data to our advantage using computational techniques, and the limitations of these approaches to socalled “dark archives”. Network visualisations are used to represent correspondence visually in order to shed light on the activities it represents; particularly literary collaboration and administration. The paper concludes with an attempt to draw conclusions from these analyses and to think about their implications for repositories and researchers collecting and using hybrid correspondence collections. The Python code produced for the project is collection agnostic and available under a Creative Commons Licence, meaning that any collecting repository holding email archives in MBOX format can use it to extract GDPR compliant metadata from their collections and visualise them in Gephi. A theory is presented to explain how accurate, single-joint movements are controlled. The theory applies to movements across different distances, with different inertial loads, toward targets of different widths over a wide range of experimentally manipulated velocities. The theory is based on three propositions. (1) Movements are planned according to “strategies” of which there are at least two: a speed-insensitive (SI) and a speed-sensitive (SS) one. (2) These strategies can be equated with sets of rules for performing diverse movement tasks. (...) The choice between SI and SS depends on whether movement speed and/or movement time (and hence appropriate muscle forces) must be constrained to meet task requirements. (3) The electromyogram can be interpreted as a low-pass filtered version of the controlling signal to the motoneuron pools. This controlling signal can be modelled as a rectangular excitation pulse in which modulation occurs in either pulse amplitude or pulse width. Movements to different distances and with loads are controlled by the SI strategy, which modulates pulse width. Movements in which speed must be explicitly regulated are controlled by the SS strategy, which modulates pulse amplitude. The distinction between the two movement strategies reconciles many apparent conflicts in the motor control literature. (shrink)

Analyzed F. Galton's data on the sensory, psychomotor, and physical attributes of 1,639 females and 4,849 males. The reliability of the measures, developmental trends in mean scores, correlations of the measures with age, correlations among measures, occupational differences in scores, and sibling correlations are described. Developmental trends during later childhood, adolescence, and early maturity are compared to those described in contemporary developmental psychological literature.

Mounting evidence shows that nature contact is associated with affective benefits. However, the psychological mechanisms responsible for these effects are not well understood. In this study, we examined whether more time spent in nature was associated with higher levels of positive affect in general, and lower levels of negative affect and rumination in general. We also conducted a cross-sectional mediation analysis to examine whether rumination mediated the association of nature contact with affect. Participants reported their average time spent in nature (...) each week, as well as their general levels of positive and negative affect, and the degree to which they typically engaged in rumination in daily life. We then used structural equation modeling to test our hypotheses. Our results support the hypothesis that nature contact is associated with general levels of affect, and that rumination mediates this association for negative affect, and marginally mediates this association for positive affect. The requirement of the Association to Advance Collegiate Schools of Business to include business ethics in the curriculum has prompted business programs to teach ethics either integrated across the curriculum or in standalone classes. The question addressed here is how to engage students in thinking deeply and empathetically about ethical issues impacting corporate social responsibility. This research focused on using a thought experiment developed by John Rawls in which students examined CSR issues from the perspective of six stakeholder groups. A (...) pre-test/post-test design measured the effectiveness of an instruction module on CSR coupled with an active exercise using Rawls’ veil of ignorance and original position. Results indicate that students placed greater responsibility on the stockholders and board of directors after taking this module. The implication of the Rawlsian technique to use stakeholder empathy is discussed as a tool for engaging business ethics students. (shrink)
